Kenvest Consulting Inc.: Quebec Law 25 Addendum

This Addendum applies to individuals in Quebec and to processing subject to Quebec’s Act respecting the protection of personal information in the private sector, as amended by Law 25 (the “Quebec Privacy Law”), where applicable.
1. Transparency and Consent
Kenvest Consulting Inc. will:

collect personal information only for identified purposes;

obtain consent where required (which may be express where sensitivity warrants);

provide clear information about collection, use, disclosure, retention, and cross-border processing.
2. Privacy Governance
Kenvest Consulting Inc. maintains a privacy governance framework that may include:

privacy policies and procedures;
-
workforce training and access controls;
-
incident management processes;
-
vendor/subprocessor oversight.
3. Confidentiality Incidents
In the event of a “confidentiality incident” involving Quebec personal information, Kenvest Consulting Inc. will:

take reasonable steps to reduce the risk of harm;

notify the Customer without undue delay after becoming aware;

provide information required for Customer’s compliance (including assessment details where applicable);

maintain an incident register as required (where applicable to Kenvest Consulting Inc.’s role).
4. Cross-Border Disclosure
Where personal information is communicated outside Quebec, Kenvest Consulting Inc. will implement safeguards appropriate to the sensitivity of the information and will support Customer’s compliance obligations, including providing information reasonably necessary for transfer impact/risk considerations.
5. De-Identification and Anonymization
Where used, de-identification/anonymization will be performed using reasonable measures appropriate to the context and risk.
6. Automated Decision-Making
Where Kenvest Consulting Inc. deploys systems that make decisions based exclusively on automated processing that produce legal or similarly significant effects (where applicable), Kenvest Consulting Inc. will support Customer’s compliance by providing:

meaningful information about the logic involved (as appropriate);
-
mechanisms for individuals to submit observations or request review, where required by law and within the scope of the Services.
7. Rights Requests
Kenvest Consulting Inc. will reasonably assist Customer in responding to Quebec individual rights requests, including access and rectification, where applicable.
